Can I modify the fox from the logo to make a desktop background?

Posted by aggro on Sun, 01/01/2006 - 19:18Licensing Issues

I downloaded hi-res image of the fox from links given in here:
node/3064

Then I removed the globe, twisted the fox, duplicated the result and added background and other things to the image. The result looks nothing like the logo, but anyone would instantly identify that the foxes in the image are from the Firefox logo. The idea was to make a new desktop background image, but after reading the faq. I'm not sure if I can do this.

"Q: Can I modify your logos and distribute the result? A: No, sorry."
http://www.mozilla.org/foundation/trademarks/faq.html

I don't dare to publish the result if it offends anyone or if it is against the law or the will of MoFo. But if it is possible to publish it, I don't really care under what license it is released (if it helps).

I had the same problem and email licencing@mozilla.org and they said this (in one of 2 emails)

[

http://www.mozilla.org/foundation/trademarks/policy.html covers
wallpaper. It says:

"When it comes to Mozilla's trademarked logos ("logos," for short),
there are some cool things you can do and some cool things you can't do
- at least not without asking Mozilla.

You may make t-shirts, desktop wallpaper, or baseball caps with Mozilla
logos on them, though only for yourself and your friends (meaning people
from whom you don't receive anything of value in return). You can't put
the Mozilla logo on anything that you produce commercially -- at least
not without receiving Mozilla's permission. Of course, Mozilla owns and
operates the Mozilla Store, which sells a wide range of CDs, Guidebooks,
T-shirts, and products with Mozilla software and logos. That's how we
make some of the money that keeps us around.

There are two additional broad categories of things you can't do with
Mozilla's logos. The first is to produce modified versions of them..."

]

that seems that you can make wallpapers, advertising materials, etc. so long as you get the TM/(R) in and it isn't sold (not-for-profit), then it's cool, but im still in an email conversation with them so will report back when i am clearer on the issue.

I finally got reply from Mozilla licensing team. The answer is that they don't allow wallpapers where parts of Firefox logo is used. So that's the end of this story.

Indeed; these wallpapers are not permitted by us.

>> So please tell me. Can I publish wallpapers where parts of the Firefox
>> logo is used?

No, I'm sorry. If other people are doing it, they are wrong. If you
wish, it would be helpful if you pointed them to our trademark policy.

Mozilla doesn’t hunt down people who modify their logos but you really shouldn’t modify them for their best reason, consistency. Consistency in a products logo avoids consumer confusion when identifying a product. The requirements for use of Mozilla’s logo’s and wordmarks are clearly explained with examples of what not to do at:
Mozilla’s Visual Identity Guidelines for Firefox.

Yes, I understand this for logos. But I'm making a desktop background image. And the difference is that I'm not just making my version of the logo by changing colors or something. I have made a compilite different looking image. It is something like the fox on the top banner. Everyone can see that the fox is from the logo, but that doesn't look anything like the logo.

Shouldn't all those banners and buttons in this site be illegal also, as they are violating the copyright of the person who draw the original fox?

Uploading it would mean publishing it. I don't want to publish it before I atleast know that it is legal. I
also desided to ask from the author of the Firefox logo, if it is ok for
him that I use the image. If he thinks it is not ok, I won't publish
it, even if it is legal.
